THE FOLLOWING TERMS & CONDITIONS ARE INTENDED FOR VIEWING AND USING THE APPLICATION IN ONLY AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED KINGDOM LAW. DO NOT PROCEED IN THIS SITE IF YOU ARE NOT LOCATED IN THE UNITED KINGDOM.
1. Eligibility: "Let Your Hero Out Game" (the "Game") is open only to legal residents of the United Kingdom and who are at least eighteen (18) years old at the time of entry. Subject to all applicable federal, state, and local laws and regulations. By using the application and playing the Game, entrant accepts and acknowledges unconditionally these Terms & Conditions and Sponsor's decisions, which are final and binding in all matters related to the Game. The Game is for recreational purposes and under no circumstances does it imply or include the possibility of winning a prize.
2. Sponsor and Administrator: Dell Corporation Ltd, Dell House, Cain Road, Bracknell, Berks RG12 1LF.
3. Entry period: The Game begins on Wednesday, January 11, 2012 at 4:00 a.m GMT and ends on Wednesday, January 18, 2012 at 4:00 a.m GMT (the "Entry Period").
4. How to Enter: To enter visit http://www.facebook.com/alienware during the Entry Period, and click on the "Let Your Hero Out Game" page link. Entrants can participate in the Game by clicking on the Participate button and following the instructions. The main objective is to destroy the mysterious box encasing Alienware's newest system. To break open the box, entrants will need to find and destroy 7 different weak points that are located on the mysterious box. Every entrant will have the opportunity to select a weapon and destroy the weak point that has been made available on that day. Each subsequent day participants will gain access to 1 new weapon and 1 new weak point on the box that must be destroyed. If a user misses 1 or more days of the Game they will be required to complete the tasks from the previous days in the order they were made available until they have caught up. On the final day the users can destroy the last weak point and Alienware's newest product will be revealed. Each entrant may complete this entry process only once on the above-referenced pages for a total of one (1) entry per person. Sponsor's computer is the official time-keeping device for the Game. Sponsor is not responsible for technical, hardware, software, or telephone failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled, or delayed computer transmissions which may limit or interfere with a participant's ability to take part in the Game. In addition, Sponsor shall not be responsible for any damage to any computer or other property resulting from participating in, or downloading any materials for, this Game. Each online entry shall be deemed to have been sent by the authorized account holder, at the time of such entry, of the e-mail address indicated on such entry.
In the event of a dispute as to any registration, the authorized account holder of the Facebook profile used to register will be deemed to be the registrant or player.
5. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Game, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Game, as determined by Sponsor in its sole discretion. Sponsor reserves the right, to exclude any individual from using the game if it finds him/her to be tampering with the entry process or the operation of the Game or to be acting in violation of these Terms & Conditions or any other Promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Game may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Terms & Conditions shall not constitute a waiver of that provision.
6. Limitations of Liability: The Sponsor is not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Game; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Game; (4) technical or human error which may occur in the administration of the Game or the processing of entries; (5) late, lost, undeliverable, damaged or stolen messages; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Game. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Game, provided that the Entry Period has not ended.
The Game is in no way sponsored, endorsed or administered by, or associated with Facebook. You understand that you are providing your information to the Sponsor and not to Facebook. The information you provide will only be used for the administration of the Game and in accordance with the Sponsor's privacy policy. Facebook is completely released of all liability by each entrant in this Game. Any questions, comments or complaints regarding the Game must be directed to the Sponsor and not Facebook.
7. Disputes: All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms & Conditions, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Game, shall be governed by, and construed in accordance with, the laws of England & Wales.
